COMMERCIAL LANDLORD-
TENANT LAW AND LEASES
FOR PROPERTY MANAGERS

There are many differences in the legal principles, practices and forms used in commercial tenancies as compared with their residential counterparts. This program will cover all the major areas a manager or owner’s representative should know, from leasing to evictions, and will be specific to

Massachusetts’s law. As part of the program the “Standard Form Commercial Lease” will be analyzed in detail and alternative provisions will be discussed. The instructor, who has advised property managers for decades, will offer practical suggestions throughout the program.

This is the RIGHT course for you if:

You are a property manager who is new to the area of commercial leases or who has limited experience with non-residential tenancies. The primary focus will be on office and small retail tenancies; however, the principles will apply to all commercial situations. Owners and brokers who deal with negotiating and leasing will also benefit.

After taking this course you will understand:

·              Licenses, easements, and tenancies

·              Different kinds of tenant entities (corporations, LLCs, etc.), the formalities; and how to hold responsible people liable

·              Security deposits, guaranties and similar devices

·              Rent escalations, additional rent and other financial provisions, “gross” versus “net” rent

·              Options to extend and renew

·              Assignments and subletting – how
restrictive can a landlord be?

·              Importance of “use”, insurance, waiver of
subrogation and indemnity provisions

·              What lease provisions are typically negotiated?

·              Determining who pays for repairs

·              Estoppels certificates, notices of leases and subordination agreements

·              Handling defaults and evicting commercial tenants

·              And much more!
